These Terms of Service govern your use of modernretire.com (the 'Service') and any related features, products, or services we provide. By accessing or using the Service, you agree to these terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By using the Service, you agree to these Terms of Service, our Privacy Policy, and any additional terms posted on the Service. You also consent to our practices described in these documents.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms.

3. Account and Access

You may use the Service without creating an account. If you choose to purchase Premium access, you will create an account through our authentication provider, Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

We may suspend or terminate your access if you violate these Terms or if we reasonably believe that your use of the Service is harmful or abusive.

4. Service Description

ModernRetire is a retirement planning tool that estimates financial outcomes based on information you provide, including savings, spending, Social Security, pensions, investments, taxes, and health care costs. The Service provides educational projections, stress tests, and planning guidance.

These projections are estimates only and are not guarantees of future results.

5. No Financial Advice

The Service is for educational purposes only and does not constitute financial, tax, legal, or investment advice. You should consult a qualified professional before making decisions based on the Service.

We are not fiduciaries and do not provide personalized advice tailored to your specific circumstances.

6. License and Use Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

You may not:

• Copy, reproduce, modify, distribute, sell, or lease any part of the Service;
• Reverse engineer or attempt to extract the source code of the Service;
• Use the Service to violate any law, regulation, or third-party right;
• Impersonate another person or create multiple accounts for abuse;
• Interfere with the security or performance of the Service.

7. Premium Access and Payments

If you purchase Premium access, payment is processed by Stripe. You agree to pay all applicable fees and taxes. All payments are non-refundable except as required by law.

Your access to Premium features is subject to these Terms and the terms of the payment processor.

8. Intellectual Property

All content, design, logos, software, and materials on the Service are owned by ModernRetire or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not use our trademarks or logos without our prior written consent.

9. Disclaimers

The Service is provided 'as is' and 'as available.' We expressly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, ModernRetire and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including lost profits, lost savings, loss of data, or inability to use the Service.

Our aggregate liability for direct damages will not exceed the total amount you paid for Premium access in the 12 months before the claim arose, or if you have not purchased Premium access.

11. Changes to the Service and Terms

We may modify or discontinue the Service at any time. We may also update these Terms by posting a revised version on the Service. Your continued use after changes are posted constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in California.
